These Terms & Conditions (“Terms”) govern your use of AI Migrator at ai-migrator.aiblewmymind.com, operated by AI Blew My Mind / SC INNOVALISTA SRL (“we,” “us,” “our”). By creating an account or using the service, you agree to these Terms.

1. The Service

AI Migrator helps you extract a personal AI profile from your conversation history with AI assistants (ChatGPT, Claude, Gemini, etc.). You upload your exported data, we process it using AI to extract durable facts about you, and you receive a portable profile you can use with any AI assistant.

2. Account

  • You must create an account to upload files and use the extraction service.
  • You are responsible for keeping your login credentials secure.
  • You must be at least 16 years old to use the service.
  • One account per person. Do not share accounts.
  • By creating an account, you confirm that you have read and agreed to these Terms and our Privacy Policy.

3. Your Data & Consent

  • You own your data. Your uploaded conversations and the extracted profile belong to you.
  • By uploading data, you grant us a limited, temporary license to process it solely for the purpose of extracting your AI profile. We do not claim ownership of your content.
  • AI processing consent: By using the extraction feature, you explicitly consent to your conversation data being sent to the Google Gemini API for processing. Google’s paid API does not use your data to train their models. See Gemini API Terms.
  • You are responsible for having the right to upload the data you provide. Do not upload conversations that contain other people’s confidential or sensitive information without their consent.
  • Data deletion: You can request deletion of your account and all associated data at any time by emailing daria@aiblewmymind.com.

4. Payments & Refunds

  • Certain features (exporting and downloading your full profile) require a one-time payment. This is not a subscription — you pay once and receive 3 migration credits.
  • Payments are processed securely by Stripe (PCI DSS Level 1 certified).
  • All prices are displayed inclusive of applicable taxes. Prices are in USD unless otherwise indicated.
  • Refund policy: If the extraction produces no usable results due to a technical issue on our end, contact us at daria@aiblewmymind.com and we will issue a full refund. We evaluate refund requests on a case-by-case basis.
  • Prices may change. Any price changes will not affect existing purchases.

5. Right of Withdrawal (EU/EEA Consumers)

Under EU consumer protection law, you have the right to withdraw from a purchase within 14 days without giving a reason. However, by using your migration credits (initiating the AI extraction process), you acknowledge that:

  • The service constitutes digital content that begins delivery immediately upon use.
  • Once processing begins, you waive your right of withdrawal for that specific credit, as the service has been fully performed.
  • Unused credits: If you have not used any of your credits, you may request a full refund within 14 days of purchase by emailing daria@aiblewmymind.com.

6. AI Processing

  • Your conversation data is processed using the Google Gemini API to extract facts. By using the service, you acknowledge and consent to snippets of your conversations being sent to Google’s servers for processing.
  • AI extraction is not perfect. The generated profile may contain inaccuracies, miss information, or occasionally misattribute facts. You should review and edit your profile before using it.
  • We do not guarantee the completeness or accuracy of the extracted profile. The review step exists so you can correct, remove, or edit any fact before exporting.
  • We use multiple AI models (Gemini 2.5 Flash, Gemini 2.5 Pro, Gemini 3.1 Pro) and may switch between them to ensure service availability. All models are accessed through the same Google Gemini API.

7. Acceptable Use

You agree not to:

  • Use the service to process other people’s private data without their consent
  • Attempt to reverse-engineer, scrape, or abuse the service
  • Upload malicious files or content designed to exploit the system
  • Resell or redistribute the service
  • Use the service for any illegal purpose
  • Circumvent any usage limits, rate limits, or security measures

8. Intellectual Property

The AI Migrator service, its code, design, and branding are owned by SC INNOVALISTA SRL. You may not copy, modify, or distribute our service. Your extracted profile and uploaded data remain yours.

9. Limitation of Liability

AI Migrator is provided “as is” without warranties of any kind. To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.
  • Our total liability is limited to the amount you paid for the service.
  • We are not responsible for data loss if you do not download or save your exported profile.
  • We are not responsible for inaccuracies in the AI-extracted profile. You are responsible for reviewing the results before using them.

Note for EU/EEA consumers: Nothing in these Terms limits your statutory rights under EU consumer protection law, including your rights under the Consumer Rights Directive.

10. Service Availability

We aim to keep the service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the service at any time with reasonable notice. If we discontinue the service, paid users will be able to download their data for at least 30 days.

11. Account Termination

You can delete your account at any time by contacting us. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance. We will notify users of significant changes via email or a notice on the site at least 14 days before the changes take effect.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Romania.

For EU/EEA consumers: You may also rely on the mandatory consumer protection laws of your country of residence. You have the right to bring proceedings before the courts of your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

For all other users: Any disputes will be resolved in the courts of Bucharest, Romania.
